    These terms and conditions set out the rental agreement between you and Lois & Co,  ABN 86 292 956 858

    Bookings

    • Bookings can be made directly on our website – loisandco.com.au for a rental period of 4 days duration or 8 days duration.
    • Should you wish to take advantage of our Try On At Home option, there is a fixed fee of $38.50 fee (inclusive of GST) plus a $25.00 delivery and return postage charge. You will have 24 hours to try it on at home and then simply return it to us the next day in the Express Post satchel provided.  Should you decide you will hire the Try On item for your event please contact us at lois@loisandco.com.au or on 0404 033 900 and and we will provide you with a discount code to take the $35.00 fee off your hire charge and simply charge your card with the difference between the Try On fee and the fee for your selection of either 4 day or 8 day hire. Please allow a minimum of 2 - 3 weeks for this process so should you decide not to hire the Try On item you will have time to receive another selection before your event.  
    • We do take bookings up to 6 months in advance if you are planning ahead for an extra special occasion.  You can take advantage of the Try On At Home option and pre-book using the same criteria as above.  Once you have selected your garment using the Try on At Home option, contact us either by email to lois@loisandco.com.au or on 0404 033 900 for the discount code to take the $35.00 fee off your hire charge so you can book as soon as possible. We recommend that you book your delivery date to be a minimum of 2-3 days prior to your event.  Through submitting your order you agree to authorise us to charge your payment method for the rental fee and shipping.
    • Please select a delivery date a minimum of 2 (or 3) business days prior to your event to allow for postal delivery times.
    • Orders are sent by Australia Express Post on business days, Monday - Friday. Orders placed on the weekend will be sent on the next business day.
    • Any item(s) required to be delivered on a Monday, must be booked 2 business days in advance so we can post with Australia Express Post by 12pm on the prior Thursday.

    Shipping:

    • Our postage fee is a flat rate and includes delivery to you and return to us.

    • We use Australia Post Express network operating between all capital cities (except Darwin) and for WA in Perth CBD only.  Some major centres are included in the Australia Post Express network.  Outside of these areas, next day delivery service is not guaranteed.
    • Should your delivery address be outside the Express Post network, we will use the fastest possible transport link, but it will not be covered by the Express Post next day guarantee.  To achieve your delivery in time for your event it may also require a more expensive delivery service and we will clarify this with you prior to dispatch and you may need to select an 8 day hire period.
    • Australia Express Post network guaranteed next day delivery operates only for items ordered prior to 1pm AEST.
    • The Express Post network postcodes include:

    • NT: NT is not included in the Express Post network.  For a delivery to Darwin, please contact us on 0404 033 900 or at lois@loisandco.com.au and we will work with you to get your garment to you on time.  Please allow a minimum of 3 days prior to your event and select and 8 day hire and add your event date in your booking notes.
    • If your delivery address is outside of these areas, please allow an additional 2 days for shipping or you may want to consider an 8 day hire to account for longer shipping time.  Please notify us of your event date in the order notes.

    Rental Agreement

    • Lois & Co agrees to hire our owned garments stated in the invoice / confirmation / notification / contract for a set period of time to the hirer on the following terms and conditions.
    • When you hire from Lois & Co, you are purchasing the right to wear one of our garments during the agreed hire period stated on your confirmation email and in our system. While the garment is in your possession, only you – the hirer, is able to wear this garment.
    • The hire is for the period of hire time that has been agreed on by both you and Lois & Co. After the agreed period of hire has expired, your right to have the item expires. You agree to return this item by return Australia Post Express satchel provided to you by posting to Lois & Co the day after the end date of the hire.
    • Lois & Co is the legal owner of all the hire items at all times.
    • If you are under 18 years of age, your parent or legal guardian must agree to this contract.

    Returns

    • A regular hire period is for a duration of 4 days or 8 days.
    • Returns need to be posted on the day following the expiration of the rental period in the return Express Post satchel provided by Lois & Co (unless otherwise agreed at the time of hire). The item can be tracked via the tracking number provided by Lois & Co at the time of delivery. Our preference is that you hand the item over the counter in your local Post Office to ensure the tracking code is activated.
    • Should you mislay the return satchel, you will need to purchase a replacement at an Australia Post outlet for the return of the garment.
    • Please notify Lois & Co via email to lois@loisandco.com.au urgently if there is a delay in returning the item so we can notify customers waiting for the item that there may either be a delay in their delivery, or we can assist them in selecting an alternative.
    • If you receive an item that is not as described, or faulty, please contact Lois & Co on mobile (+61 404 033 900) within 2 hours of receipt of the item and we will arrange an exchange, or refund of the booking fee once the item is received back.
    • Unless we are notified of a delay in returning an item, late returns will attract a late fee of 25% of the hire price per day that the return is late, after the day we would have expected return delivery by Express Post (ie. two days following your event date). Late fees will be charged to the customer credit card details that were provided at the time of booking.
    • If the customer has not returned the rental item(s) within 15 days after the return date, Lois & Co will consider the rental item(s) as non-returned and to enable us to purchase a replacement item, we will charge the User’s credit card $300.00 in addition to the rental cost that the User has already paid. The credit card on file will be charged and if unsuccessful, we will refer to our collection agency for action.

    Cancellation Policy

    • A cancellation fee per order applies to all cancelled bookings.
    • If you wish to cancel a Booking, a cancellation request must be submitted to us via email to lois@loisandco.com.au within 3 days prior the delivery start date.
    • If your booking is cancelled 14 days or less before shipment, we will issue you with a credit voucher valid for 12 months, equal to the value of your booking minus a cancellation fee of $15.00.
    • Once a product has been dispatched a request for a credit voucher equal to the value of your booking minus a cancellation fee of $15.00 will be considered on a case-by-case basis, with the expectation the garment will be returned to Lois & Co immediately upon receipt.  Any credit voucher to be issued will be done so after return receipt by Lois & Co of the garment. 
    • If not redeemed, credit vouchers expire at the end of the 12 month period and cannot be extended or reissued.

    Lois & Co Cancellation Rights and Obligations

    Lois & Co reserves the right to cancel a booking at short notice. Reasons for cancellation may include (but are not limited to) an item not being available due to late return by a previous customer or an item being returned damaged. Lois & Co will endeavour to provide as much notice as possible. In the event of a cancellation by Lois & Co we offer a full refund, credit voucher equal to the full value of the booking (minus postage fees) or the option to change the booking to another item.

    Late Order Request

    If a customer places an order less than 3 business days prior to the start date of the rental booking, this is considered a Late Order Request. Lois & Co do not take responsibility for any post delays caused by Australia Post.  Late orders are not eligible for a refund (in the case of late delivery past the booking start date, or failure to deliver by Australia Post). Customers may request credit voucher equal to the value of the booking which will be valid for 12 months, by notifying Lois & Co via email. The credit voucher is exclusive of postage and GST.

    Try On Orders

    Bookings for a Try On at Home option are non-refundable once the item has been dispatched. 

    Pricing Changes 

    At Lois & Co we do our best to keep our hire fees as low as we possibly can to ensure we can provide a service to suit a variety of styles, sizes, and budgets.  However, we may find it necessary to adjust our fees from time to time and Lois & Co reserves the right to do so by applying any fee adjustment to the product(s) affected.

    Condition of Hire Items

    Some items available to hire from Lois & Co may have been worn previously and are dry cleaned by a professional company.  We also have qualified seamstresses at our disposal to mend and repair items. The condition of hire items are ‘as new’ or ‘near new’.  Due to the item possibly having been worn multiple times, there may be minor imperfections. We request that all customers inspect garments prior to wearing but confirm that when we determine a garment is no longer in ‘as new’ or ‘new near’ condition it will be withdrawn from our range.

    Although items are cleaned and steamed prior to dispatch, should an item arrive with slight creases please do not attempt to iron it.  Either steam it on low heat with a clothes steamer or hang it in your bathroom while you shower.  The steam created will help remove any creases.

    We are pleased to be participating in a sustainable and ethical move to protect our environment and reduce clothing waste going into landfills, and by doing so being able to offer an affordable solution to our customers to dress well for special occasions. 

    Garment Sizes and Fit

    At Lois & Co we are aware that body shapes and sizes vary, and even a garment labelled as a particular size may also vary between manufacturers.  For this reason, we have provided the measurements for each garment available on our site in the chart in the Sizing section below the booking calendar. 

    It is important that prior to selection, the hirer takes and records their own measurements (or has a friend or partner do so) and then use those measurements when selecting a garment referring to the chart in the Sizing section.  In general, to measure yourself:

    Bust:  Wearing just your bra, measure about the largest part of your bust and under the arms ensuring the tape is straight across your back.

    Waist:  Standing as you normally would, measure around the narrowest part of your natual waistline.

    Hips:  Standing up straight with your legs and feet together, take the measurement around the largest part of your bottom.

    Dry Cleaning​

    Lois & Co will arrange to dry clean the garment after the hire period. We use experienced dry cleaners familiar with the care instructions of our special garments.  Customers agree not to attempt to clean the dress themselves.  If the customer attempts to clean the dress and it results in permanent damage, additional costs may incur.

    Damage to hired Items/Lost and Stolen Hired Items

    • We expect our customers to take reasonable care of the hired item. However, it is possible some damage may occur. For minor damage or staining that is repairable for a cost of less than $100.00, we will not charge customers.
    • Lois & Co provides damage insurance which is included in the hire fee to the value of one hundred dollars Australian (AU$100) to cover minor damage or staining.
    • Should any repair or cleaning be more than $100.00, Lois & Co will assess on a case-by-case basis if the customer will be required to pay any difference (e.g. if the repair cost is one hundred and fifty dollars ($150), then the customer may be required to pay the fifty dollars ($50) difference. The repair or replacement costs will be charged to the credit card details that were provided at the time of booking. Customers will be notified of all charges in advance.

    Social Media 

    • When you are looking and feeling fabulous and enjoying your event, please be sure to tag @loisandco_ on Instagram or Lois & Co on Facebook! Where we feature customer content on our social media platforms, we offer you a $20 credit voucher via email as a ‘Thank you’.
    • And please remember, we will never ever ask for your financial details via social media.

    By renting a garment I accept these terms and conditions.

    By accepting these terms and conditions, I authorise Lois & Co to charge the credit card provided or PayPal according to the terms outlined above. This payment authorisation is for the goods/services described above, for the amount or amounts indicated above only. I certify that I am an authorised user of this credit card/ PayPal and that I will not dispute the payment with my credit card company; so long as the transaction corresponds to the terms detailed in this document.
